Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DualStream website, desktop application, chat relay service, and related services (collectively, the “Service”). The Service is operated by Dual Stream Studio Inc (“DualStream”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

• “Account” means a registered user account created to access the Service.
• “User”, “you”, “your” means any individual or entity that accesses or uses the Service.
• “Application” or “App” means the DualStream software client.
• “User Content” means any content you stream, upload, display, transmit, or otherwise make available using the Service.
• “Third-Party Platforms” means services like Twitch, YouTube, Kick, TikTok, and other streaming or social platforms.
• “Chat Relay” means the DualStream service that aggregates and relays chat messages from connected Third-Party Platforms exclusively to DualStream application sessions where you are logged in with your account in real-time. Chat data is never sent to other DualStream users or third parties.
• “Custom RTMP” means any RTMP streaming endpoint you manually configure that is not a directly integrated Third-Party Platform.

2. Agreement to Terms

By installing, accessing, or using the Service, or by clicking “I agree” where presented, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated by reference.

3. Eligibility

You must be at least 13 years of age, or the minimum age of digital consent in your jurisdiction, to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian. You may not use the Service if barred by applicable law or subject to trade sanctions or export controls.

4. Account Registration and Security

To use certain features, you must create an Account with accurate, current, and complete information. You are responsible for keeping your login credentials confidential and for any activity under your Account. Notify us immediately at support@dualstream.gg of any unauthorized use or security incident. We reserve the right to suspend or terminate any Account at our discretion.

5. Beta Access and Pre-Release Features

Beta Features are provided as-is, may be incomplete or unstable, and may change or be discontinued at any time. By using Beta Features, you understand that data loss, instability, or interruptions may occur, and that we may convert Beta Features into paid features or withdraw them entirely.

6. Subscriptions, Fees, and Payment

Some features require a paid Subscription. Billing is processed through Stripe. All fees are in USD unless stated otherwise. Subscriptions renew automatically unless canceled before the renewal date. You may cancel at any time via your account settings. You are responsible for applicable taxes.

7. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and run the App and access the Service for your personal or internal business purposes.

You may not: copy, modify, or create derivative works; reverse engineer or decompile the Service; remove proprietary notices; resell or redistribute the Service; or use it for any unlawful purpose.

We retain all rights, title, and interest in the Service except for User Content.

8. User Content and Streaming Activity

You retain all rights to your User Content. DualStream does not claim ownership. By using the Service, you grant DualStream a worldwide, non-exclusive, royalty-free license to use, host, store, transmit, display, and process your User Content solely as necessary to operate the Service.

You are solely responsible for all content you stream, compliance with applicable laws, obtaining necessary rights and permissions, and compliance with Third-Party Platform terms.

Prohibited Content:

• Illegal, infringing, defamatory, obscene, hateful, harassing, or harmful content
• Content promoting violence, self-harm, or illegal activities
• Child sexual abuse material or exploitation of minors
• Malware, viruses, or harmful code
• Content violating third-party intellectual property, privacy, or publicity rights

9. Third-Party Platforms and Integrations

The Service enables connections to Third-Party Platforms (Twitch, YouTube, Kick) via OAuth. Your use of those platforms is governed by their own terms. We store stream keys and OAuth tokens in AES-256-GCM encrypted form.

YouTube: Your use of YouTube features is subject to the YouTube Terms of Service and the Google Privacy Policy. DualStream complies with the Google API Services User Data Policy. You may revoke access at myaccount.google.com/permissions.

Multi-Platform Simultaneous Streaming: Some platforms may restrict simultaneous streaming to competitors. It is your sole responsibility to verify that your agreements with each platform permit multi-platform streaming. DualStream is not liable for any consequences imposed by Third-Party Platforms as a result of multi-platform streaming.

10. Custom RTMP Destinations

You may stream to Custom RTMP endpoints not directly integrated. You are solely responsible for the legality and authorization of streaming to any Custom RTMP endpoint, compliance with the destination's terms of service, and the security of the endpoint. DualStream does not verify or vouch for any Custom RTMP destination.

11. Chat Relay Service

The Chat Relay aggregates chat messages from your connected platforms and delivers them exclusively to DualStream application sessions where you are logged in with your account. Your chat data is completely isolated from other users — no other DualStream user can access your chat messages or platform events through the relay. Chat messages are relayed in real-time and not persistently stored. Chat content originates from third parties — DualStream does not author, endorse, or assume responsibility for third-party chat content. DualStream provides moderation tools but is not obligated to moderate chat on your behalf.

12. Acceptable Use and Prohibited Activities

• Do not violate any applicable law, regulation, or third-party right
• Do not engage in fraud, phishing, spam, or deceptive activities
• Do not interfere with or disrupt the Service
• Do not attempt unauthorized access to any part of the Service
• Do not circumvent access controls, rate limits, or security measures
• Do not circumvent bans or restrictions imposed by Third-Party Platforms
• Do not access Subscription features without a valid Subscription
• Do not share or transfer your account credentials or Subscription

13. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, store, and disclose personal information.

14. Service Availability and Updates

We strive to keep the Service operational but do not guarantee uninterrupted or error-free operation. We may update, modify, or discontinue features at any time.

15. Feedback and Suggestions

If you send us feedback or suggestions, you agree that we may use them for any purpose without compensation or obligation to you.

16. Intellectual Property

“DualStream”, its logos, trademarks, and trade names are the property of Dual Stream Studio Inc. Except for the limited license granted to you, no other rights or licenses are granted.

17. Term and Termination

These Terms remain in effect while you use the Service. We may suspend or terminate your access at any time if you violate these Terms or applicable law. Upon termination, your right to use the Service ceases, but locally stored data on your devices remains yours.

18. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. LIVE STREAMING INVOLVES INHERENT RISKS. YOU USE THE SERVICE AT YOUR OWN RISK.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUALSTREAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

20. Indemnification

You agree to defend, indemnify, and hold harmless DualStream from claims arising from your use of the Service, your User Content, your violation of these Terms or any law, or your use of the Service with Third-Party Platforms or Custom RTMP destinations.

21. Export Control and Sanctions

You may not use the Service if located in a country subject to comprehensive U.S., UK, or EU sanctions, or if listed on any government prohibited parties list.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved through good-faith negotiation, then binding arbitration under the American Arbitration Association rules. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Claims must be filed within one (1) year.

23. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email, in-app notice, or banner. Your continued use constitutes acceptance of the updated Terms.
